Welcome to Positive Mind Care ("we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our Learning Management System platform, courses, and related services (collectively, the "Service").

By using our Service, you agree to these Terms. If you are enrolling on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

1. Overview

Positive Mind Care provides an online learning platform offering courses, live classes, assessments, and certificates. The platform enables students to access educational content, track their progress, and earn recognized certifications upon successful completion.

2. Eligibility

To use the Service, you must:

Be at least 13 years old (users under 18 should have parental or guardian consent)
Provide accurate and complete registration information
Have the authority to enter into a binding contract
Use the platform only for lawful educational purposes and in compliance with these Terms

3. Account Registration

a. Account Creation

You may need to create an account to access courses. You agree to:

Provide accurate, current, and complete information during registration
Maintain the confidentiality of your account credentials
Update your information promptly if it changes
Be responsible for all activity under your account
Not share your account with others

b. Student ID

Upon registration, you will be assigned a unique Student ID that identifies you within our system. This ID will appear on your certificates and academic records.

c. Account Security

You must notify us immediately at support@positivemindcare.org if you suspect unauthorized access to your account. We may suspend or terminate access to protect your account and the Service.

4. Course Enrollment and Access

a. Course Purchase

Courses may be free or paid
Paid courses require payment through our secure payment gateway (Razorpay)
All prices are displayed in Indian Rupees (INR) unless otherwise stated
Payment must be completed before accessing paid course content

b. Access Rights

Upon successful enrollment:

You receive a personal, non-transferable, non-exclusive license to access the course
Access is granted for the duration specified in the course details (typically lifetime access unless stated otherwise)
You may not share, distribute, or resell course access to others

c. Course Content

Course content is provided for personal educational use only
You may not download, copy, reproduce, or distribute course materials except as explicitly permitted
Video content, PDFs, and other materials remain the intellectual property of Positive Mind Care or the respective content creators

5. Acceptable Use

You agree not to:

Use the platform for any illegal or unauthorized purpose
Share your account credentials with others
Download or distribute course content without permission
Disrupt or interfere with the platform's operation
Use automated tools or bots to access the Service
Harass, abuse, or harm other users or instructors
Submit false information or impersonate others
Attempt to bypass payment systems or access control mechanisms
Upload malicious code or engage in any security testing without authorization
Use the platform to promote or sell products or services

We reserve the right to suspend or terminate any account that violates these guidelines.

6. Live Classes

a. Attendance

Live class schedules are provided in advance
Attendance is encouraged but may not always be mandatory
Sessions may be recorded for later viewing by enrolled students

b. Conduct

During live classes, you must:

Be respectful to instructors and fellow students
Use appropriate language and behavior
Not disrupt the class or share inappropriate content
Follow the instructor's guidelines

c. Technical Requirements

You are responsible for having a stable internet connection
We are not liable for technical issues on your end that prevent attendance

7. Assessments and Quizzes

a. Academic Integrity

You must complete all assessments independently unless group work is explicitly permitted
Cheating, plagiarism, or using unauthorized resources is strictly prohibited
We use anti-cheating measures and may invalidate results if misconduct is detected

b. Grading

Quizzes and assessments are graded according to published criteria
Passing scores are determined by the course instructor
You may retake assessments as allowed by the course policy

8. Certificates

a. Eligibility

Certificates are issued upon:

Completing all required course content
Achieving the minimum passing score on assessments
Meeting any other course-specific requirements

b. Certificate Validity

Certificates are digitally signed and verifiable
Certificates contain your name, Student ID, course details, and completion date
Certificates remain valid and cannot be revoked except in cases of fraud or Terms violation

c. Certificate Use

You may share your certificate for educational or professional purposes
You may not alter, modify, or misrepresent certificate details
Positive Mind Care may verify certificate authenticity upon request

9. Payment and Refunds

a. Pricing

Course prices are displayed clearly before purchase
Prices may change without notice, but changes do not affect already-purchased courses
You are responsible for any applicable taxes

b. Payment Processing

Payments are processed securely through Razorpay
We do not store your credit card or banking information
You authorize us to charge your payment method for the course fee

c. Refund Policy

Free Courses: No refunds applicable
Paid Courses: Refund eligibility depends on the specific course policy
Generally, refunds may be available within 7 days of purchase if less than 20% of content has been consumed
To request a refund, contact support@positivemindcare.org with your order details
Refunds are processed within 7-10 business days after approval
Payment gateway charges may not be refundable

d. Course Cancellation

We reserve the right to cancel courses due to:

Insufficient enrollment
Instructor unavailability
Technical or operational issues

If we cancel a course, you will receive a full refund.

10. Intellectual Property

a. Platform Ownership

All content, software, and branding on our platform (excluding user-generated content) are owned by Positive Mind Care or licensed to us. This includes:

The platform name, logo, and branding
Course content, videos, PDFs, and materials
Platform UI, codebase, and infrastructure
Assessment questions and learning materials

b. User License

You may not:

Copy, modify, distribute, or create derivative works from our content without written consent
Remove copyright notices or watermarks
Use our content for commercial purposes
Reverse-engineer the platform

c. User Submissions

If you submit content (assignments, feedback, comments):

You retain ownership of your content
You grant us a license to use, display, and process your content for operating the Service
You represent that you have the right to share the content

11. Third-Party Integrations

Our platform uses third-party services including:

Razorpay - Payment processing
Mux - Video hosting
100ms - Live classes
AWS S3 - Content storage

When you use these integrations:

Their respective terms and privacy policies apply
You are responsible for any data you share with those services
We are not liable for any issues arising from third-party services

12. Termination

a. By You

You may stop using the Service at any time. You may request account deletion by contacting support@positivemindcare.org.

b. By Us

We may suspend or terminate your access if you:

Breach these Terms or violate laws
Engage in fraudulent or abusive behavior
Fail to pay for services
Use the platform in a harmful manner

c. Effect of Termination

Upon termination:

Your access to courses and content ends
You lose access to certificates and progress data (unless we are required to retain them)
Already-issued certificates remain valid
No refunds are provided for termination due to Terms violations

13. Disclaimers

The Service is provided "as is" and "as available." We make no warranties-express or implied-about:

Continuous, uninterrupted availability
Fitness for a particular purpose
Accuracy or completeness of course content
Achievement of specific learning outcomes

Content Accuracy

While we strive for quality:

Course content is for educational purposes and may not be 100% comprehensive
You are responsible for verifying information before applying it professionally
Instructors' views do not necessarily represent our official position

14. Limitation of Liability

To the maximum extent permitted by law:

Positive Mind Care shall not be liable for any indirect, incidental, or consequential damages
Our total aggregate liability shall not exceed the amount paid by you for the course in question
We are not liable for technical issues, data loss, or learning outcomes

15. Indemnification

You agree to indemnify and hold Positive Mind Care, its affiliates, instructors, and employees harmless from any claims, losses, or damages arising from:

Your misuse of the Service
Your violation of these Terms
Your infringement of third-party rights
Your conduct during live classes or interactions

16. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

17. Changes to These Terms

We may update these Terms periodically to reflect:

Changes in our services or policies
Legal or regulatory requirements
Operational improvements

If changes are material:

We'll notify you via email or platform notification
The "Last updated" date at the top will be revised
Continued use of our Service after updates means you accept the revised Terms

18. Governing Law and Dispute Resolution

a. Governing Law

These Terms are governed by the laws of India.

b. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through:

Arbitration: If informal resolution fails, disputes shall be subject to arbitration under the Arbitration and Conciliation Act, 1996
Jurisdiction: Courts in New Delhi, India shall have exclusive jurisdiction

19. Miscellaneous

a. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Positive Mind Care.

b. Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

c. No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

d. Assignment

You may not assign or transfer these Terms without our consent. We may assign our rights and obligations without restriction.
